Temporary Residency for Vietnam | TR for Vietnam
A Vietnam Temporary Residence Card is one of the required documents for the foreigners who plan to stay at the hotel or intend to extend their Vietnam Visa.
People from the following categories are eligible to this visa:
- Individuals, obtaining citizenship outside of Vietnam who is a member of the two-member limited liability company or more,
- A foreigner who is the owner of the one member limited liability company( except as authorized representatives,
- A foreigner who is a member of the board director of the stock corporation,
- A foreign lawyer who is licensed to practice following Vietnam law by the Vietnam Ministry of Justice;
- A foreigner who have a working permit in Vietnam or are representatives officially of foreign companies,
- The Government approved Professionals, students, trainees who are in the national working or studying programs which are signed between the ministries,
- Relatives of the temporary resident card holder including spouse, children and parents
Procedures for the new issue of Temporary Residence Card:
- a written request for a temporary residence card (Form N7A);
- declaration about foreigners applying for a temporary residence card (form N7B) with two image size photos;
- copy of passport and a valid visa( bring an original for comparison);
- copy or duplicate of legal agencies, organizations, sponsor businesses record that need proposal temporary residence card.
As each case, foreigners may summit the following documents:
- investment certificate,
- business registration license,
- branch company( including active notices) seal registration certificate
- established representative office license,
- photo of working permit( bring original for comparison);
In the cases of bringing relatives the foreigner must submit some documents as such:
- birth certificate
- Household registration evidence or marriage certificate, etc.
Citizenship for Vietnam:
Foreign nationals who have held a Permanent Resident Card for five years may apply for Vietnamese citizenship.
Naturalization will be viewed in a case the applicant satisfies the following conditions:
• Having the full civil act capacity as prescribed by Vietnam’s laws.
• Conforming Vietnam Constitution and laws;
• Being capable of making their livelihood in Vietnam.
• respecting the customs, traditions and practices of the Vietnamese nation.
• Comprehension of the Vietnamese language adequately enough to coordinate themselves into the Vietnamese community.
An individual intending to apply will be asked to file a dossier to the Justice Department of the locality where he/she lives. The application package will consist of:
• An application for Vietnamese citizenship.
• Photocopy of permanent residence document.
• Copy of birth certificate, passport, or another appropriate document for replacement.
• Curriculum vitae letter approved by the Ministry of Justice regulation.
• written certification of the monthly salary or income, provided by the employing organization or agency of the applicant;
• Criminal history record issued by a relevant Vietnamese administrative office for the time span the applicant has resided in Vietnam and a criminal history record provided by a responsible foreign body for the period the applicant lived in a foreign country.
Papers proving the applicant’s ability to make a living in Vietnam (any apply):
• Document approving property ownership rights;
• paper proving the guarantee by an organization or individual in Vietnam;
• written records of taxable incomes, provided by a tax office;
• written certification of the applicant’s ability to make his/her living in Vietnam, made by the People’s Committee of the commune, township or ward where the applicant resides.
Judicial records must be provided within 90 days prior to the date of dossier completion. Papers evidencing the applicant’s Vietnamese language skills (any apply):
• copy of a Vietnamese college, postgraduate, university, lower secondary, upper secondary, or professional secondary diplomas;
• a copy of a diploma or certificate of Vietnamese language issued by a Vietnamese language training body.
In a case the applicant does not have above mentioned documents, but states that knows Vietnamese enough to coordinate himself herself to Vietnamese community, the Department of Justice should interview him/her to test the knowledge of Vietnamese language under the control of the Ministry of Justice.
Work Permit for Vietnam
Foreigners intending to acquire a work permit in Vietnam must be at least 18 years old, have educational background applicable to the job they are trying to acquire, disclose any criminal record they may have, submit medical records, and be sponsored by an organization which is registered in Vietnam. However, a work permit is not required if the worker’s stay is under three months. Standard work permits have a validity of 36 months. The Department of Labor, Invalids, and Society is body in charge of providing work permits.
The following requirements should be met for getting a work permit:
• Letter from the employer should be obtained which will confirm your position in the country,
• Three passport-sized photos are required,
• Evidence of health check-up should be obtained,
• A criminal record should be obtained from the applicant’s home country.
Visa for Vietnam
Currently, Vietnam is more open, so outsiders intending to travel the country have opportunity to directly apply at the Vietnam Embassy/Consulate which is situated in their countries of residence. If foreign nationals have stayed in Vietnam for more than one year, and wish to stay longer in Vietnam, the best option is to apply for a temporary residence. This type of card is provided by qualified administrative office which manages entry and exit under the control of the Ministry of Public Security. It is one to three years validity.
